Barbados Public Workers´ Co-operative Credit Union Limited (BPWCCUL)

 “Just Go for It” Spend & Win Promotion

Unless otherwise expressly agreed in writing by the parties, these Terms and Conditions shall govern the marketing initiative called BPWCCUL - “Just go for it” (hereinafter the “Promotion”).  The Promotion is organized and executed by Barbados Public Workers´ Co-operative Credit Union Limited (hereinafter referred as “BPWCCUL”), a corporation incorporated under the laws of Barbados, sponsored and amplified by MASTERCARD INTERNATIONAL INCORPORATED (hereinafter referred as “MASTERCARD”). BPWCCUL is the sole and exclusive entity responsible for executing the Promotion and granting the benefits.

 

1. DEFINITIONS

For the purposes set forth in these Terms and Conditions, the following definitions shall apply:

 

“Benefits”: Exclusive benefits or grand prizes for two Mastercard Cardholders who accumulate the highest number of points within the promotion period. The promotion gives the chance to win a 4-night, 5-day trip to Madrid, Spain including round trip air fare and accommodation for 2 two cardholders plus a companion, for each one.

 

¨ Benefits Mechanic¨: To win the benefits or grand prizes, the cardholder must accomplish with the following requirements: 1) Accumulate the highest amount of points by achieving their personal spending goal  as much times as they can during the campaign period, 2) Open the first promo email sent by ¨BPWCCUL¨, and click the automatic register bottom during the campaign period, 3) spend in the selected categories: (Drugstores, Apparel, Automative fuel, Groceries, Eating places and Home Improvement Centers * (Appendix 1). The cardholder’s spending goal will be shared via email by ¨BPWCCUL¨ during the first week of the campaign period. The 2 two cardholders that open the email, click the register bottom and accumulate the highest amount of points of all the credit union participants by reaching the spending goal as much times as possible and make purchases within the 6 selected categories, by the end of the campaign period, will be the winners. In the case of a tie, the winner will be selected by the following criteria: A) the cardholder that achieves the points first, within the campaign period B) then, the one that has more selected categories within the purchases during the campaign period and C) finally the one who registered more transactions during the campaign period.

 

¨Instant Rewards¨: the instant reward is an Amazon gift card/voucher valued at $30 USD ($60 BBD).

 

Instant Rewards Mechanic¨: To win the instant rewards, the cardholder must meet the following requirements: 1) Achieve the spending goal 1 time during the campaign period, 2) open the first promo email sent by ¨BPWCCUL¨ and click the automatic register botton during the campaign period, 3) spend in the selected categories: (Drugstores, Apparel, Automative fuel, Groceries, Eating Places and Home Improvement centers * (Appendix 1). The cardholder’s spending goal will be shared via email by ¨BPWCCUL¨ during the first week of the campaign period. The first 275 cardholders that open the email, click the register botton and achieve the spending goal 1 time and make purchases within the 6 selected categories by the end of the campaign period, will be the winners. In the case of a tie, the winner will be selected by the following criteria: A) the cardholder that achieves the spending goal first within the campaign period, B) then by the one that has more selected categories within the purchases during the campaign period, and C) finally by the one who registers more transactions during the campaign period. The cardholders can win the instant rewards only 1 time. The instant rewards are going to be delivered within the campaign period, and the cardholders must meet all the requirements by the billing cut-off period defined by  ¨BPWCCUL, there are going to be 3 billing cut-off periods within the campaign period and cardholders will be rewarded until the 275 winners are completed or until the third billing cut-off, whichever happens first.

“BPWCCUL’s App and Website”: BPWCCUL will push this Promotion through its own social media and physical channels (Banking App, Website, In-Branch screens and/or Point of Sale materials).

 

“Promotion”: The Parties agree to join a marketing initiative to promote and incentivize the use of BPWCCUL MASTERCARD Debit Card products in the Barbados and internationally. It is scheduled to begin on September 15th, 2024 and continue until November 22nd, 2024.

 

"Participant and/or Cardholder": Any person over 18 years of age, domiciled in Barbados, who is a BPWCCUL Mastercard Debit Card cardholder, who opens the promo welcoming email, clicks to get automatically registered during the Participation Period and makes online and card present purchases. Each participant must declare that by deciding to participate in the Promotion, they are accepting the Terms and Conditions of the Promotion, and state that they know and accept the conditions, obligations and limitations set forth herein.

 

“Participation Period”: The period in which Participants must make transactions to participate in the Promotion begins on September 15th, 2024, at 00:00 hours and continues until November 22nd, 2024, at 23:59 hours.

 

“Terms and Conditions” refers to this document, the conditions, obligations, and limitations set forth herein.

 

2. GENERAL TERMS.

These Terms and Conditions apply to the exclusion of any other terms and conditions referred to, proposed by, or relied on by BPWCCUL, whether in negotiation or at any stage in the dealings between MASTERCARD and BPWCCUL, regarding the Promotion.

 

The Promotion is conducted and organized by BPWCCUL. The provisions herein shall be binding on the Participants.

 

All decisions of BPWCCUL will be final in all matters related to the Promotion. Any violation of the procedures and/or conditions of participation and/or systems established for the conduct of the Promotion will result in the immediate exclusion of the Participant and/or the revocation of the Benefit/Prize.

 

3. PROMOTION DESCRIPTION

Participants should make their online or card present purchases at any merchant in the selected categories, during the Participation Period. Participants will have the chance to win a 4-night – 5 day luxury trip to Madrid, Spain including round trip air fare and accommodation for 2 two cardholders plus a companion for each one.

BPWCCUL will amplify this promotional campaign through its own media and physical channels (Banking App, Website, In-Branch screens and Points of Sale). A non-transferable, non-exclusive, royalty-free license to use MASTERCARD logos and trademarks for this Promotion, will be provided to BPWCCUL, solely and exclusively for participating in the Promotion, during the Participation Period.

 

4. PARTICIPANTS

Cardholders who received communication via email with their transactional goals, have a debit card and belong to the Credit Union are eligible to participate for the Grand Prize/benefit and instant rewards.  The benefits do not apply to credit union employees, manager or directors.

 

5. EXCLUSIONS

Participants whose MASTERCARD is blocked or cancelled for any reason are not eligible to participate. If this situation is verified at any time during the campaign, the Participant will be excluded from the Promotion.

 

6. SUSPENSION OF THE PROMOTION

BPWCCUL will immediately suspend the Promotion, without assuming any responsibility if there is any crime, fraud or any irregularity in the way of participating, making transactions, with the means of payment, or in the behavior of any of the Participants during the Promotion and/or during the receipt of the Prizes, or if any circumstance of force majeure should arise that affects the interests or good faith of the BPWCCUL or MasterCard Commerce and/or Franchise.

 

7. LIMITATION OF LIABILITY

MASTERCARD assumes no liability for any goods or services purchased by BPWCCUL Participants .

Neither BPWCCUL nor MASTERCARD will be responsible for any difficulties that may arise at the time of payment. In the event of any inconvenience with the payment card, or discussion about its validity, available funds, and in general any matter that may affect the payment, the Cardholder acknowledges that neither MASTERCARD nor BPWCCUL is responsible for such and must make any required queries in the usual manner.

 

8. MISCELLANEOUS

If necessary and/or at the discretion of MASTERCARD and/or BPWCCUL, MASTERCARD and/or BPWCCUL reserve the right to expand and/or clarify the scope of these Terms and Conditions and/or any of the procedures. MASTERCARD reserves the right to exclude the benefit/prize and/or cease offering it prior to the end of the Participation Period.

9.  APPLICABLE LAW

Participants acknowledge and agree that the applicable law for any dispute arising in connection with this Promotion shall be the law of Barbados and waive their right to initiate any claim in any other jurisdiction.

 

10. ANTI-BRIBERY AND CORRUPTION LAWS AND COMPLIANCE

The Parties recognize that MASTERCARD and any person or entity acting on its behalf must comply with international laws related to anti-bribery and corruption including the U.S. Foreign Corrupt Practices Act, the UK Bribery Act, and other applicable law.  BPWCCUL shall comply and shall ensure that each of its approved or permitted subcontractors and personnel complies, with all applicable anti-bribery and corruption laws applicable to business dealings, including with government officials (as defined below) and any implementing regulation in respect of any such laws. BPWCCUL warrants, represents and covenants to MASTERCARD that BPWCCUL (and each of its employees, subcontractors and personnel) has not and shall not, in connection with the activities contemplated by this document or in connection with any other business activities involving MASTERCARD, make, promise or offer to make any payment or transfer of anything of value or any other advantage directly or indirectly through a representative, intermediary agent or otherwise: (i) to any government official; (ii) to any political party; or (iii) to any person for the purpose of improperly influencing any act, omission to act or decision of such official, political party or individual or securing an improper advantage to assist the Parties in obtaining or retaining business. MASTERCARD also warrants, represents and covenants to MASTERCARD that BPWCCUL and each of its employees, subcontractors and personnel shall not, in connection with any business activities involving MASTERCARD, accept anything of value from any third party seeking to influence any act or decision of BPWCCUL or to secure an improper advantage to that third party. “Government official” is defined as any employee or officer of a government of a country, state, or region, including any federal, regional, or local government or department, agency, enterprise owned or controlled by such government, any official of a political party, any official or employee of a public international organization, any person acting in an official capacity for, or on behalf of, such entities, and any candidate for political office. Failure by BPWCCUL to comply with this clause's terms will constitute a material breach of this agreement.

These Terms and Conditions are available for consultation during the Participation Period via the credit union's website.
