OFFICIAL TERMS AND CONDITIONS

1. Organizer and Administration

1.1. The “Back to School — Education Powered by Capita” campaign (the “Campaign”) is organized by [Barbados Public Workers’ Co-operative Credit Union Limited] (the “Organizer” or “BPWCCUL”), solely with respect to its own members.

1.2. The Campaign is operated and administered on behalf of the Organizer by [Capita Financial Services Inc.] (the “Administrator”), with campaign services provided by K2 Investments Inc. (the “Operator”), a service provider engaged through Mastercard International Incorporated. Mastercard is not an organizer of the Campaign and awards no prizes.

1.3. These Terms govern exclusively the Campaign run by BPWCCUL for its members. A parallel campaign run by another credit union under the same creative concept is governed by its own terms; transactions made with cards issued by any other institution do not count toward the ranking under these Terms.

2. Campaign Period

2.1. The Campaign runs for eight (8) weeks, from [August 3, 2026] at 12:00 a.m. to [September 27, 2026] at 11:59 p.m., Atlantic Standard Time (AST) (the “Campaign Period”).

• Phase 1: [August 3 – August 30, 2026] (weeks 1–4). The “First Cut” closes on [August 30, 2026] at 11:59 p.m. AST.
• Phase 2: [August 31 – September 27, 2026] (weeks 5–8). The “Final Cut” closes on [September 27, 2026] at 11:59 p.m. AST and covers the entire Campaign Period.

2.2. Only Qualifying Transactions (Section 4) carried out and posted within the Campaign Period count toward the rankings. Transactions posted after the relevant cut-off do not count toward that cut, even if initiated before it.

3. Eligibility

3.1. Participation is open to natural persons who, throughout the Campaign Period: (a) are eighteen (18) years of age or older; (b) are members of BPWCCUL; (c) hold an Eligible Card (Section 4.1) that is active and in good standing; and (d) are residents of Barbados.

3.2. The following persons are not eligible to participate or receive prizes: directors, officers and employees of the Organizer, the Administrator, the Operator, Mastercard, and any agency or supplier directly involved in the Campaign, as well as the members of their immediate household or immediate family (spouse or partner, parents, children and siblings).

3.3. Entry is automatic: every eligible member who makes at least one (1) Qualifying Transaction during the Campaign Period is automatically included in the ranking. No registration, fee or minimum spend target is required to enter. [NTD: confirm automatic enrollment vs. registration step; if enrollment is automatic, the campaign privacy notice must cover it]

3.4. Participants must remain in good standing (no card cancellation, delinquency event or breach of the cardholder agreement) at the time of the relevant cut-off and at the time of prize delivery. The Organizer’s determination of good standing is made in accordance with its ordinary policies.

4. Eligible Cards and Qualifying Transactions

4.1. “Eligible Card” means a Mastercard credit and/or debit card issued by BPWCCUL in Barbados.

4.2. “Qualifying Transaction” means a purchase of goods or services made with an Eligible Card at a point-of-sale (POS) terminal [or through e-commerce], in Barbados or abroad, that is authorized, settled and posted to the card account within the Campaign Period. 4.3. The following are not Qualifying Transactions and do not count toward any ranking:

• Cash withdrawals at ATMs, cash advances, quasi-cash transactions, and money transfers;
• Payments of fees, interest, penalties or other charges of the card account, and loan or obligation payments;
• Gambling, betting or lottery transactions;
• Transactions that are cancelled, reversed, refunded or subject to a chargeback (their amount is deducted from the participant’s total; if deducted after a prize is awarded, Section 7.5 applies); and
• Transactions that are unauthorized, fraudulent, or made in breach of the cardholder agreement.

5. Mechanics and Rankings

5.1. The Campaign is a merit-based spending race. There is no drawing, raffle, sweepstake or any other element of chance: winners are determined exclusively by their position in the rankings described below.

5.2. First Cut (Phase 1). At the close of Phase 1, participants are ranked by their total billed amount of Qualifying Transactions [at POS] during Phase 1. The ninety-five (95) highest-ranked participants win the First Cut prizes set out in Section 8.

5.3. Final Cut (full Campaign). At the close of the Campaign Period, participants are ranked by their cumulative billed amount of Qualifying Transactions during the entire Campaign Period (weeks 1–8). The twenty-five (25) highest-ranked participants win the Final Cut prizes set out in Section 8.

5.4. Winning a First Cut prize does not exclude a participant from winning a Final Cut prize. [NTD: confirm double-award rule with the client]

5.5. Progress communications and any leaderboard shown during the Campaign will identify participants only in pseudonymized form (e.g., first name and initial, or a masked member reference). Full rankings will not be published.

6. Tie-Breaking

6.1. If two or more participants tie on the amount relevant to a ranking position, the tie is resolved in favor of the participant who first reached the tied amount, determined by the date and time (AST) of posting of the Qualifying Transaction with which that participant reached the tied amount. If a tie persists, it is resolved in favor of the participant whose first Qualifying Transaction of the relevant period was posted earliest.

6.2. Under no circumstances will a tie or any other aspect of the Campaign be resolved by lot, draw or any method involving chance.

7. Validation, Winner Determination and Notification

7.1. Rankings are compiled from the Organizer’s transaction records, which are the sole authoritative source. Transactions are validated before winners are confirmed; amounts of excluded, reversed or refunded transactions are deducted.

7.2. Winners are determined within [ten (10)] business days after each cut-off, once validation is complete. The announcement flow shown in Campaign communications is indicative; no prize is confirmed before validation.

7.3. Winners will be notified by email to the address registered with the Organizer [and/or by phone]. Winners must confirm acceptance and delivery details within [ten (10)] business days of notification. If a winner does not respond within that period, declines the prize, or is found ineligible, the prize passes to the next participant in the ranking.

7.4. Prize determinations made in accordance with these Terms and validated records are final, without prejudice to the participant’s right to raise a query through the channels in Section 14.

7.5. If, after a prize is awarded, reversals, chargebacks or evidence of fraud or manipulation show that the participant’s ranking position was not legitimately obtained, the Organizer may require the return of the prize or its value and adjust the ranking accordingly.

8. Prizes

8.1. The Organizer awards one hundred and twenty (120) prizes in total: ninety-five (95) in the First Cut and twenty-five (25) in the Final Cut, as follows (values in United States dollars):

8.2. Amazon.com gift cards are delivered digitally to the winner’s registered email address. Gift cards are issued and redeemable subject to the terms and conditions of their issuer (including activation, expiration and country-of-use restrictions), which the Organizer does not control.

8.3. Physical prizes (laptops and tablets) will be delivered to winners within [six (6)] weeks of confirmed acceptance, shipping included. [Import duties and taxes associated with the delivery of physical prizes into Barbados are borne by the Organizer/Administrator.] [NTD: confirm delivery flow, who imports, and who bears duties — the winner must not receive the prize encumbered]

8.4. Prizes are personal, non-transferable and not redeemable for cash. If a prize becomes unavailable for reasons beyond the Organizer’s control, it will be replaced with a prize of equal or greater value.

8.5. Product warranties for physical prizes are those of the manufacturer. Amazon, Apple and Acer are not sponsors of the Campaign, are not affiliated with it, and have no responsibility for it.

8.6. Any tax applicable to the receipt of a prize shall be handled in accordance with applicable Barbados law.

9. Personal Data

9.1. The Organizer is the data controller of its members’ personal data processed for the Campaign. The Administrator, the Operator and Mastercard process personal data on the controller’s behalf, under contract, solely to run the Campaign (segmentation, campaign communications, ranking computation, validation and prize fulfillment). 9.2. Data processed: member name, contact details, card reference and transaction data (amounts, dates and merchant category) strictly as needed to compute rankings. Processing is carried out in accordance with the Barbados Data Protection Act, 2019-29.

9.3. Data may be processed on servers located outside Barbados, subject to appropriate safeguards. Campaign data will be retained only for the duration of the Campaign and for [ninety (90)] days thereafter for auditing and prize delivery, after which it will be deleted or anonymized, without prejudice to the Organizer’s ordinary records.

9.4. Winners’ identities will be announced publicly only in pseudonymized form or, where the Organizer wishes to use a winner’s full name or image in publicity, with the winner’s prior express consent. Participants may exercise their data protection rights through the contact channel in Section 14.

10. Disqualification

10.1. The Organizer may disqualify, and withhold or recover prizes from, any participant who: (a) manipulates or attempts to manipulate the rankings, including through simulated, circular or self-dealing transactions; (b) uses the card in breach of the cardholder agreement or applicable law; (c) provides false information in connection with the Campaign; or (d) engages in fraud or abuse of the Campaign mechanics.

11. Limitation of Liability

11.1. The Organizer and the Operator are not liable for: (a) failures of telecommunications networks, email delivery or third-party infrastructure beyond their reasonable control; (b) the redemption, availability or value of gift cards, which depend on their issuer; or (c) delays in the delivery of physical prizes attributable to carriers or customs, provided reasonable steps are taken to complete delivery.

11.2. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Barbados, including under applicable consumer protection legislation.

12. Changes, Suspension and Early Termination

12.1. The Organizer may modify, suspend or terminate the Campaign for legitimate operational, legal or regulatory reasons. Changes will be announced through the same channels used to publish these Terms and will not affect prizes already earned at the time of the change.

13. Acceptance and Publication

13.1. Participation in the Campaign implies acceptance of these Terms. These Terms are published at [URL / branches / campaign landing page] and prevail over any summary contained in advertising material.

14. Queries and Contact

15. Governing Law

15.1. These Terms and the Campaign are governed by the laws of Barbados. Any dispute not resolved through the contact channels above shall be submitted to the competent courts of Barbados.
